		<description>The prosecution(DA) could apply for appeal for a mistrial to be declared on point of law being that Copperhead has no metagene but I don&#039;t think such a verdict could be reached without it actually being suffienctly proven he has a metagene. The lack of apparent blood tests would indicate there is no precedent for this defense which would  mean the grounds for this type of defense would be determined by this case itself.
Of course we only see the closing statements so CH&#039;s meta status may have been determined then but as said before CH has no active metagene. He may have a dormant metagene but CH has enough of a criminal history and should&#039;ve had he metagene status confirmed years ago right?
Oh well, it&#039;s a ridiculous retcon anyway. Any generic metahuman would have been just as effective. I&#039;m just going to call it a continuity flub and be done with it.</description>
